Most definitely it is about "who" and not if.

However, for now it would appear that the court has no problem with shutting down the show room and assembly line. (using your automotive analogy)

Meanwhile you have forward thinking individuals like Bertelsmann who is willing to work toward a business model that properly remunerates the copyright holders..

Where does that leave the recording alliance that chooses to just "shut it down".

Do you eventually end up with each recording company with their own download fee based service? Maybe. But I think consumers will balk. If they are unwilling to form some type of industry alliance that allows full distribution of media content, they will be acting contrary to their own survival. I agree with you that the Court cannot ultimately stop it.

I wonder if the anti-napster forces know the old saying,
"half a loaf is better than none"...
