Censorship among the people you hang with is fine. I don't hang with the KKK and no one can force me to. And if they wanted to be on a moderated thread I ran- I would moderate them off. FREEDOM of ASSOCIATION.

That is like saying if you violate the laws of physics you will be killed, and you therefore need no speed laws. Speed laws are not enforceable when no one is around. So go as fast as you want when no one is around. When interacting with people that seem just nasty and incapable of acting otherwise, THAT is not a TOU violation.

I'm not particularly offended that, let's say, the pottery chat area is limited to discussions of pottery and that people that want to perform semi-lewd cyber-sex acts in public should and can be moderated off if it offends the person who chartered of the thread. Is there some aspect of the moderation process that you are upset about?
