I'm not sure how close they were. We and most of the world recognize anything outside the 12 mile boundary as international waters. Also Japan is an ally so I wouldn't see any problem with them being inside that limit.

Real question appears to be why did the Navy have a CIVILIAN pull the levers that lead to the sub ascent!!??
