I read your discussion with TLC about removing offending posts without being booted. You didn't read TLC's post, but I doubt very much that it violated the Terms of Use anyway, he was just being considerate. Be that as it may, the enforcement guidelines for the TOU make it clear that intentions matter, and repeat violators are treated more harshly than first offenders. Which is consistent with the way that justice systems work in general. People who are apologetic and make restoration are treated more leniently.

I think you gave the example of someone who shoplifts and returns the item. Yes, it is still a crime. But you set up the hypothetical wrong. The real parallel would be, not someone who has been arrested, but someone who hasn't been arrested. If that person goes back to the store and returns the items, it's up to the storeowner to decide whether to press charges, not the police. I've even seen, a number of times, cases where a petty thief has made restitution and the storeowner has asked that charges be dropped, even after an arrest. In case you don't know it I am a lawyer.

My older son stole a piece of candy from Walmart when he was very young, and I made him go to the store manager and apologize and pay for the candy out of his allowance. The store manager was happy to get the apology. I think the fact that someone has learned their lesson is grounds for lenience.

As for linking the URL to your business to your profile or thread header, how is that a violation of the TOU?
