I wouldn't worry about class actions.

There are about a 1000 cases similar to this one. Many are going into their second decade. Although the site lists a handful of "settlements" when I have followed them up they appear to have just been dropped. Once in a while a small company with real fraud settles, but its been years since I heard of a major company paying up.
