I can't imagine anyone suing over new guidance. The quarterly conference call had all sorts of cautionary language. Granted, it had some comments about taking market share, but those would be hard to pin down.

Now, if they knew about the lowered numbers and didn't tell JDSU they were going to warn, they (JDS) might be reason to challenge the price of the Zurich facility. I'm assuming they were told.
