Constitutionally the responsibility is that of the states.
Is it incredible to want to follow that, or to think the state governments are not incompetent to deal with the situation?

I have never has my BAC content measured. I imagine that it is possible that once or twice I drove at that level. Perhaps there should be some repercussions but the amount you are impaired at .08% is a lot less then at .1 or .12. I don't think you should face the same level of penalty. Perhaps .07 or .08% should get you the equivalent of a speeding ticket. Maybe levels far above .1% should have greater penalties.
