I would be surprised if JDSU decided to sue one of its best customers -- might not be a winning strategy.

Stock prices go up, they also go down. JDSU can't sell the NT shares in less than a year. I suspect that at this time next year, they'll get more than the announced price for the fab.

All the same, the PR was a necessary step to keep JDSU's shareholders and the class action lawyers from going after JDSU. I see this as a strategic step to reduce the probability of a successful suit against JDSU when the biggest growth industry in the USA realizes that their share price fell too and it's also a company with some money.
