I think the defendant in a law suit usually knows whether he did or didn't do what he is accused of - the problem is that he doesn't usually know what to do about it. And I doubt if most attorneys have heard of SLAPP suits or anti-SLAPP suit laws - I learned about them a long time ago in the context of environmental law, long before they became popular as a way of hushing up people who post on the internet. So the defendant probably needs to consult with a lawyer, and he may need to bring the lawyer up to speed on the law.

I certainly learned a lot from these websites.
