God bless your opinion, which you are most entitled. I think differently, of course. For either Ms. Day or myself to point out your misunderstanding of the facts of the Varian (VAR & VSEA), Susan B. Felch and George Zdasiuk SLAPP, at least as you have stated them, would be less than a good way to spend my evening. If indeed you think you understand this SLAPP lawsuit, I commend you. I can only hope the California Appeals Court comes up to speed as quickly as you, since Ms. Day's recently submitted Opening Appeals Brief includes a 15-volume, 4,335 page Appendix.

In any event, thank you for pointing out what you believe to be the folly of our Internet ways, it is always appreciated. Speaking for Ms. Day, we both look forward to our SLAPP trial, which if we ever get a definitive date requires a majority of six out of nine jurors to find either of us guilty of whatever tort the four Plaintiff's claim. And as you know, I have a $50M Verified Cross-Complaint in place as well.
Lastly, I will most assuredly continue to post the truth about the Varian fascist plaintiffs and their despicable Orrick, Herrington & Sutcliffe attorneys here and elsewhere and for as long as I care to exercise my First Amendment Privilege. Free speech is oh so important!

Whew! That's quite a mouthful, KJC! I certainly appreciate your efforts at attempting to digest the Varian SLAPP since I am constantly astonished by the Plaintiffs, their attorneys, and their motives (the most confusing part of all).
I do agree that what the Varian SLAPPers have done and are doing is quite outrageous. I can understand your utter disbelief that two corporations would behave in such a fashion and be spending millions in their attempt to shut Delfino and I up. Rather than go through your posting point by point to address what I believe are your misconceptions about the case, may I suggest this? Why don't you print out your posting here #1111 and also print out my Opening Brief in the California Appellate Court from this link:
geocities.com which pretty much sums up my position on the Varian SLAPP. Regrettably, this link does not show the entire 15 volume, 4335 page appendix that my attorney sent to the Appeals court last week but I think you'll get the gist of the argument.
As the case evolves you can periodically check off which statements in each of these documents remain true and which do not.
I do appreciate the dialogue and your efforts to study the Varian SLAPP which may be the longest running and possibly the most protracted Internet SLAPP on record.
