i think jackson intentionally helped msft by his bizarre statements to the press. the reaction of the appeals court is no surprise. it might have been less explicit, but it obviously would have been shocked by jackson's statements to the press. perhaps the appeals court is letting off steam, but won't decide completely for msft. i wonder why after deciding against msft, but staying his decision, jackson went out of his way to help msft and hurt his reputation. it is also obvious that jackson did not want the case on remand.
