Dear ____:

This confirms our agreement to resolve the issue of the subpoena served on Yahoo! on behalf of our clients E*TRADE Group, Inc. and E*TRADE Securities, Inc. (collectively, "E*TRADE").

You previously made postings to the Yahoo! Finance EGRP message board using the screen names "Christos_Cotsakos" and "Kathy_Levinson." Without admitting any liability, you agree and promise that you will not in the future impersonate any officer, director, or representative of E*TRADE and will not otherwise hold yourself out to others as an officer, director, or
representative of E*TRADE, whether on internet message boards or elsewhere.

In exchange for and on the condition that you abide by this agreement, E*TRADE agrees to withdraw all subpoenas served upon Yahoo! with respect to you, and agrees not to seek to add you as a party to or otherwise to identify you in the John Doe action filed in San Mateo County Superior Court (Case No. 415073). Upon receiving a countersigned copy of this letter agreement from you, I will immediately contact Yahoo! to withdraw the pending subpoena as to you and will send you a copy of my letter confirming that fact. That will be the end of this matter as to you.

E*TRADE (inlcuding my law firm) will maintain your name and address in confidence and will not disclose your name and address in court papers or otherwise to any third party unless disclosure is necessary in order to enforce this agreement or in order to protect E*TRADE's legal rights in the event of unlawful conduct by you in the future.

THE DONK MESSED UP ONE DAY BY POSTING AS AN OFFICER OF E*TRADE. UH...MAKE THAT TWO OFFICERS OF E*TRADE. SURE I WAS JOKING, BUT I DID IT. THOSE ARE THE FACTS, ANY WAY YOU SLICE IT. I CROSSED THE LINE.

FIRST TIME TOO.

SO SEEING AS I SCREWED UP, HERE ARE MY CHOICES:

I CAN FIGHT THIS. I CAN IGNORE THE FACT THAT I SCREWED UP, AND GO AFTER E*TRADE BECAUSE...WELL...BECAUSE THEY HAVE MORE MONEY THAN ME. THIS WOULD RESULT IN A BEST CASE SCENARIO OF...

1. DONK SPENDING LOTS OF MONEY ON ATTORNEY FEES.
2. TRUE IDENTITY OF DONK BECOMES KNOWN IN COURT.
3. YOU, ALONG WITH A BUNCH OF MY CLOSEST "FRIENDS" FROM THIS BOARD SHOW UP AT THE TRIAL.
4. LATER THAT NIGHT, I GET A KNOCK ON MY FRONT DOOR.
5. I HAVE TO REPORT MY LEXUS STOLEN.
6. I HAVE TO REPORT VANDALISM OF MY HOUSE.
7. IF I'M LUCKY, I "WIN" THE CASE WHICH MEANS I'M ONLY OUT ANOTHER $20,000 IN ATTORNEY FEES.

OR...

I CAN BE A SMART JACKASS AND KNOW A GOOD DEAL WHEN I SEE ONE.

YOU SEE JAMES, WHEN YOU SCREW UP YOU FACE THE MUSIC. E*TRADE IS BEING REAL COOL IN THIS MATTER. I AM NOT GOING TO LOOK A GIFT HORSE IN THE MOUTH. NOT THIS JACKASS.

THEY HAVE ASSURED ME THAT MY PERSONAL INFORMATION WILL NOT LEAK OUT. I HAVE NOTHING TO HIDE. THEY CAN PULL UP MY ACCOUNT ACTIVITY ON THEIR SCREEN. NO SMOKING GUN.

I SCREWED UP. TO RECONCILE THE SITUATION I NEED TO SIGN A LETTER PROMISING TO BE NICE IN THE FUTURE. IF I DIDN'T WANT THIS TO HAPPEN, I SHOULD HAVE THOUGHT MORE ABOUT IT BEFORE I USED THOSE ALIASES LAST YEAR.

My issue with E*Trade has nothing to do with free speech. It has to do with impersonating a corporate officer.

I do believe that you did the right thing Donk. There's no need to pay lawyers to fight such a stupid thing.

But, there is a free speech issue if one is acting as an imposter where it is obviously satirical. You certianly could dress up like Kathy Levinson and picket the ET offices, if it was plainly satirical. Why should posting to this board be any different.

P.S. Could you send photos of you dressed like Kathy.

We all know what kind of crap I've posted here. Stuff you wouldn't want your family, neighbors, employers, co-workers, or anyone else for that matter to hear about. Sure I was just funnin', but outside this board, outside this "environment", others would never see it that way.

Never.

And it could get much uglier too.

Ultimately I would have "won". I do not doubt that. But at what cost?

I wish all decisions in life were this easy.
