RR, thanks for the link on the Napster legal issue. Today the Court gave Napster 72 hours to demonstrate that its system for blocking unauthorized copying is effective. Reports published so far indicate that just a slight change in the title of a piece of music, including spelling differences, is enough to allow the copying of the material. The court will not allow this attempt to circumvent its decision. I suspect that Napster will be at least temporarily out of business before the weekend. And if illegal copying still goes on, then Napster could be held in contempt.

You're absolutely right that a key underlying issue is the fact that firms such as Napster can make money (through the sale of advertising on its web site) merely by providing the facility to allow illegal copying. Even if Gnutella and others are less convenient, their software will still make them liable for loss of copyright fees.

As I mentioned earlier, there are solutions to this dilemma, and SanDisk has designed at least an acceptable solution.
