1. I, under the alias of Bellarico28 and Stockarazzi_2000, have drafted and published numerous postings on Viragen's bulletin boards. As part of my settlement agreement with Viragen Inc., I have disclosed to Viragen, Inc.: my name; address; social security number; and drivers license number.
2. Several of these postings have been determined by Viragen to be defamatory to Viragen, its directors, officers, employees, and shareholders.
3. I drafted and published these postings only to satisfy my desire to be recognized as important by the other posters on the bulletin board. I did not publish these postings in concert with any third (3rd) party and was not compensated by any person or corporation, and did not profit, in any way, for publishing same including, but not limited to, short sales. This was a grievous mistake which may have damaged everyone involved.
4. These postings may have been viewed by many thousands of people around the world who visit this website to read about Viragen.
5. I apologize to Viragen, its directors, officers, employees, and shareholders for the damages that my postings may have caused.
6. I hereby denounce my actions and wish to warn others that hiding behind a fake identity does not give one poetic license and the right to defame others.
7. I hereby give Viragen the right to post this publication on all websites and bulletin boards which discuss Viragen, and to publish same in any medium and manner that it so chooses.

Could you maybe post a link to the "Several of these postings have been determned by Viragen to be defamatory to Viragen, its directors, officers, employees, and shareholders."? I'd like to see how this "grievous mistake...may have damaged everone involved." Those posts must have been more damaging than certain posters posting an expected $5-$20 pop in this stock on the open after trading was halted in December.
PS - I did like your "apology" better than Philly's ---- in my opinion, it's not quite as whiney.

Thank you Viragen, thank you management, you guys are the greatest! ! ! We love you. You sure know how to run a company. This is great! How many months now has it been since Bellarico28 quit posting on this board? But our management team wouldn't let it go, they obviously have priorities!!! And the beauty of it all is how much they are doing for our shareholder value. I can hardly believe how much our price has zoomed since this nasty basher quit posting. I'm sure now with this public humiliation we will go thru da roof. Back up the truck folks ! ! !

How much in attorney's fees did you have to pay to reach this settlement? Was it worth it?

I don't know if this post is true but the tone and the intent sound eerily familiar. My plaintifs (the same names are involved in many suits) had a 4-5 paragraph letter they wanted me to sign as a condition for dismissal. After writing my own version We (Eric & I ) refused to publish any letter & decided to stand our ground.

You have not responded to the Mutual Settlement and Release Agreement tht I sent you on April 17,2001. As a result, I assume that you have rejected same. And, from our telephone conversation, I believe that you have rejected same due to fear of having your name published over the internet.
I have relayed what I believe is your fear to my client. As a result, my client has suggested an alternative settlement publication. As you will see the attached, the revised settlement publication does not require you to post your name over the internet. My client has graciously proposed this revised settlement publication as it is in the business of healing poeple, not destroying people. And, while my client believes it has been harmed by you and has suffered public contempt, my client does not want the public to show you the same contempt on a personal level. My client merely wants you to apologize to it in the same forum in which you harmed my client.
Accordingly, please find the modified mutual settlement and release agreement. If it is acceptable to you, please sigh same and make a copy for your records. Return the original signed agreement to me in the enclosed self addressed stamped envelope. And, attach to same, as Exhibit "B" and forward to me, a true and correct copy of your drivers license.
Please contact me if you have any questions or comments regarding same. Please be advised that if you reject this settlement ofer and do not contact me to discuss same, as you did to my previous Mutual Settlement and Release Agreement, my client will be forced to amend its complaint to name you as the defendant and will serve you, personally, with its complaint. The first place plaintiffs' lawyers will go is not the ISP but the
host where the speech was posted, usually Yahoo or Raging Bull. I would
probably have him contact both his ISP and Yahoo or whoever not just to ask
if they give notice but to demand notice.
If he gets notice, a motion to quash the subpoena will be needed
very quickly and probably have to be filed in Fla"......
