No argument here. I believe that the daytrading measure, like SuperMontage, decimalization, some of the order handling rules, Reg FD (and the list goes on while the beat rolls on) have, in common, good intentions with unanticipated (or "anticipated, though overruled") consequences.

It's just that in this case pertaining to daytrading rules, I personally find some logical, redeeming factors that I didn't in decimalization, with Reg FD, etc.

But: I think that all of you make valid points, and if the rule is changed, hey - the people will have spoken, and that's terrific.

You could take the "diabolical" POV and see decimalization, SuperMontage and these new rules all aimed at the same result: pulling the little guy out of the day trading game.

We need to realize that this would not have happened if the industry didn't stand behind it. When it was first proposed, I was struck by the supportive quotes of the usual suspects. I also think, at that time, they thought they could make up the shortfall with an ample supply of new talent. As it turns out, that has dried up significantly over the past year. As a result, many of the EDT broker-dealers will probably be closing their doors if they depend of the retail speculator. Quite a bit of irony there.

Just a note on the business side of my income. I probably stand to gain from all this with a best-selling book on swing trading, but as a student of the markets and free enterprise, it gives me no pleasure. But new doors are opening, which I suspect will be themes for me for quite some time. I've just completed preparations with Matthias (supertip) for a European tour this June. Looks like many dates in Germany and Great Britain:

Short-term speculation is sure to survive somewhere on the planet over the next few years. ;-)
