III.C.3.a) Courts attempt to arrive at a reasonable royalty by calculating what a reasonable and prudent licensee will pay a reasonable and prudent licensor.
This indicates that part "B" is applicable. Clearly, if a patent turns out to be near useless due to the part "B" analysis, it will not be applied with a 2-10% royalty rate.

I have never, ever, ever, ever stated that I thought a "third party should make decisions on what RMBS should be paid for its IP." If you go back and look through this thread you will find the bulls screaming for the courts to force memory makers (and others) to pay royalties, not me. As far as I can see, there is no infringement.

But with the case in court, and soon to jury, that is what seems likely to happen. (That is, a court will decide the royalties, if any.) The question that I have been posing is that of "what is Rambus' IP?". My contention is that it doesn't have much to do with SDRAM or DDR, just as Rambus had very little to do with the development of those technologies.

I believe that the free market should rule.

The market has ruled against RDRAM.

Without the courts and lawyers, Rambus doesn't seem to have much going for it.
