No tax, no dividend..

In the current legal environment, Xcelera felt too gun-shy to say 'word one' about the situation. Look at Rambus...difficult to interprete the legal machinations, but it all looks "bad" and the stock price is acting accordingly.

Xcelera's PR people told Xecelera to put out a statement regarding "working, but no final answer on tax situation" earlier. Xcelera declined to do that. They waited until it was checked, double-checked, and...etc. That is the reason for the wait.

See the press release. Tax classification means no payment of taxes on Exodus stock sale gain. No need to re-imburse shareholders. Xcelera has plenty of working capital (instead of CMGI's debt..billions of debt!) to fund promising technology.
