How will the courts decide if something is a hate crime? Let's say a black guy kills a white guy because he hates whites. What criteria will be used to determine whether or not it is a hate crime? Will it be the manner in which the murder was committed? Will the prosecutor just ask the perpetrator? Is it only a hate crime if a white guy/gal commits it?

Too vague imo. The Byrd case is a good example of the lameness of proposed hate crime laws. GWB said it best when he said (paraphrased) "how much worse can you punish someone than putting them to death"? I am a fairly smart guy and I don't think there is an answer to that except maybe to torture the person, but most will not support that.
