You wish to dissect intent, You wish to know(guess) what is in the mind of another. You wish to give discretion in the application of sanction based upon the subjective interpretation of what is really in the mind of another as you think you know what it is. You wish to be GOD.

A person who hates and acts upon that hate has already lived life in a prison that has deprived him of seeing what is beautiful. Unfortunately a cage or a noose is the only place for this individual. In many instances the not quite so bad get carried in emotions of the moment to very evil places. So taking all into account the legal system should define what is wrong and what happens if you break the law as measured by act and intent. The current discretion in the number of charges made and the scale of sanction can take care of hate or the shade of intent of intent.
