Their are definately times when you can tell it is a hate crime, but it would be relatively easy to hide the fact if you wanted. This is where whites could actually get penalized imo. If you hate white guys so you rob them and beat them up (or worse), who is to say that it is more than a robbery. It will only be obvious when it is a minority of some type and that will allow for different penalties for different groups. Kind of like that 7-2 Florida recount decision in a way.

That said, there are degrees of viscousness that should be penalized more aggressively and they are through extenuating circumstances that allow for options like no possibility of paroll or the death sentence.
