I agree. But I would expand this to include, it would weaken industry innovation.

No startup would share their IP, without IP protection. And, if IP protection can't be found in the courts, then the only way to protect your IP, aside from creating development barriers, is to simply block companies from having access to it, which means: no sharing, no cooperation, no licensing (why license and share something that can be legally stolen?).
