Your argument doesn't hold true either. It's not uncommon for lawyers to do this knowing that the company would find it cheaper to pay the lawyers off rather than spend money on another set of lawyers trying to defend themselves. It's kind of a legalized blackmail. Pay us a little or pay your lawyers a lot to try and prove us wrong. That is why the shareholders never make out in these things when the settlements are reached.
