Yes, Markman rulings are reversed in the order of 50%. That is because we now have an outstanding court of appeals on patent claims that hears all such appeals. They have special expertise and experience that district court judges lack.

I am not a patent lawyer, so I cannot comment specifically on the nuances of the prosecution history, however it would seem a little counter-intuitive to preclude RMBS' innovations from applying in a slightly different configuration than the one that may have been the focus of the initial patent application.

Like you, my bet is premised on the risk/reward of RDRAM alone, which I believe more than justifies the current valuation. But if the Bus wins its legal battles, fortunes will be made.
