Yes, I agree that he is leaning towards IFX' spin on the JEDEC issues. This can be gleaned from (1) his allowing the waiver of A/C privilege based on the crime/fraud exception, (2) his permitting the RICO claim to go forward, and (3) the final pages of his Markman ruling, in which he stated that he believed RMBS' expert was acting as an advocate. All of this may have influenced his claim construction, i.e., given that district court judges are somewhat out of their depth in patent cases, they must decided which side is being more forthright, and then to some extent rely on their claims constructions.

Having said that, I don't think he's "biased." I think that, until this latest IFX document issue, he bought into IFX' JEDEC story. If that unravels, you may see him starting to consider whom the good guys might really be...
