Jeff: I am not sure this will answer your question, but I believe that in mid-1999 the Federal Courts first allowed SLAPP motions to be brought in Federal Court. (See Newsham v. Lockheed Missiles and Space Co., Inc. (1999, 9th Cir.) 190 F.3d. 963).

Yes, you are absolutely right that as SLAPP plaintiffs get more and more adept at masking SLAPPs the more difficult it becomes for SLAPP defendants to recognize a wolf in sheep's clothing. Hopefully this thread and the johndoes.org helps to raise the knowledge base for those posting on Internet financial message boards. And hopefully our case in the California Court of Appeals will set a precedent to at least deter Internet financial message board SLAPPs in California.
