Yes, and the Bible expects the man who caused the miscarriage to pay, just as you would expect your lamp to be paid for. He gets money, the amount decided by a judge. The man is not killed. If he were, it would do more harm than good to all involved.

Edit: If I broke the lamp in your room while fighting with your sister and the law proposed amputating my arms and legs, for example, you (and your family, and mine) might think that punishment less appropriate, and less to your advantage, than my recompensing you, and perhaps paying extra as punitive damages for my carelessness.
