I don't think anyone is getting away with something because of a technicality. The interpretations are a value added product. You seem to put a high value on respect and consideration and at the same time defend Brinker. I believe that you are sincere and am truly baffled. Brinker's treatment of public figures is often down right disrespectful. During the campaign he called George W. Bush an empty suit more than once. He has negative nicknames for many known market technicians. A thread using his name was creating on SI to specifically attack someone who, at the time, could not post to defend himself. You make a good point about putting a good foot forward, when going forward. In Brinker's case, he revises history to exaggerate positive aspects or to make people believe that the negatives never happened.

re: "then to go on and summarize his show, and then to turn a profit on it is plain and simply foul."

god I was hoping we could avoid repeating all this that was said in the past when Justa was still around. Bob does exactly what Korn is accused of. He summarizes Barrons articles and uses them to fill up part of his radio show which he gets compensated for. Personally, I dont see anything wrong with this or what David does, legally or morally.

This is common practice in the news business. Pick up a copy of USA today or watch any news show, and you will see that they are summarizing work from the Journal of the AMA, Forbes, Fortune, and just about any publication on the planet. How many news firms of non affiliated stations and networks are mentioning these stupid TV shows...

How many news organizations mention Money Magazine's best Places to Live every year and how many mention the richest people from the Forbes list every year.

I dont understand how Bob gets off expecting special treatment and how others support his position so vehemently.
