Re:"First of all, since the claims in the 1990 document are not public, Infineon (or you and I) cannot be held to infringe them. "

Wrong again BILOW! You must not be familiar with US patent law. Infineon can be held to infringe the claims as of the date of issuance of the patent. The claims were granted by the patent office and apply to everyone in the US.

This has been gone over many times before. You do not seem to understand US patent law. RAMBUS was allowed to write claims on the on the inventions in its original patent application by the US PTO. The process used is the normal process of the PTO. No special treatment was given to Rambus in obtaining these patents.
