What on earth are you rambling about?

Claims can not be enforced until the patent is issued in the USA.

You may not like US patent procedure but that is the law.
Perhaps, things are different where you are.

Actually, Carl, just like in Japan, in Europe (and Germany) unissued patents are publicized, I believe a year after the application, the 1990 patent can probably be found in the European patent data base. Retroactive enforceability of claims is not the issue, I think that if there is an issue of infringement, it will be of "wanton Infringement" from the date of issue (in each country).
