a. I don't think the FUD is over but I think investors are more keyed into it than ever before.

b. Yes, I think the BU$$ will prevail, the patent office would be on their side and this case really goes to the reasoning behind protecting intelectual property (inluding future, unthought of at the time, uses).

c. I agree with the range, my lines in the sand are at $ 23.00 and $ 35.00

The last two of these seem to present the last best hope of RMBS. That is to say there is some possibility that before their appeals are concluded, or perhaps in the course of their own appeals they can get the Courts to revisit Festo and the topic of Equivalents.

But IMHO, it is either that or a reversal of the Markman ruling that they should be shooting for. This will be a very tough road to travel, but if they are able to avoid a fraud or RICO judgment at trial I suspect they will try to pursue it.
