not sure what you are referring to; i remember something on the thread a few days. Most states have unfair trade practice laws, which apply, e.g., in Texas to "disparaging" the goods or services of your competitor--that is, telling lies. I would love to see someone use those statutes against what has become an all to common practice corporate practice of FUDD, disparagement. The problem is it takes a competitor to bring the suit and proving one's case is difficult. Much of the FUDD is "opinion." You have probably heard about the Pizza Inn suit against its rival; I believe the Supreme Court has taken the case, so we may have some idea of the parameters. One of the problems there is that most of the advertising, in my opinion, has been hyperbole and too general. The NOK statement of which I am aware directly claimed NOK's technology is cheaper, which is a direct affirmation of fact.
