The overlapping, or additional, patents for W-CDMA is the reason for Spinco. Q Classic will not be a producer of anything related to W-CDMA, and therefor will reap no benefit from cross-licensing. Just pay the royalty due. Spinco will produce the chips, and will be given enough patents to be included in any GSM style no-royalty-due cross-licensing between other W-CDMA IPR claimants.

I don't think we have seen any discussion of DoCoMo's W-CDMA IPR claims. Wouldn't they be like QCOM in that they don't produce a product, but do have patent claims. No benefit to cross-license, just pay them as well?
