No, the courts gets to decide what constitutes getting trampled upon, according to the intent of the Bill of Rights, and reasonable extrapolations therefrom. Of course, they are not always rght, but they have the authority.

As I said, I agree about official, public prayer before sporting events. That comes a bit too close to proselytizing, or, at least, requiring too much conformity from members of the team and regular attendees.
