<B<DJN: =DJ Polymedica Call -2: Analyst Wants More Detail On Probe
(Dow Jones 04/03 14:09:39)
By Johanna Bennett
Of DOW JONES NEWSWIRES

NEW YORK (Dow Jones)--PolyMedica Corp. (PLMD) Chairman and Chief Executive
Steven Lee said the government probe into the company and its Liberty
Medical Supply Inc. unit is civil, not criminal, despite the participation
of the Federal Bureau of Investigation.
During a conference call Tuesday morning between management, analysts and
investors, Lee said "it is my understanding" that the company is dealing
with the civil unit of the Department of Justice. The remark came after an
analyst questioned whether the FBI's participation in the case indicated
that a criminal investigation is underway.
"That is not our understanding at the moment or the understanding of our
counsel," Lee said.
As the analyst pressed for clarification, Lee asked to defer any further
answers. He later explained that PolyMedica is dealing with a civil unit of
the Justice Department for whom the FBI is gathering information.
"This is a good question," Lee said. "But I have not really had a chance to
think it through so rather than attempt to answer the question right now
without proper thought, let me defer for now and we will deal with that
later."
A spokesman for the Department of Justice contacted Tuesday said the FBI
does not handle civil matters. But a spokeswoman for PolyMedica said the
situation is "convoluted."
PolyMedica's conference call is the latest development in a difficult 10
days for the company and its stock.
Shares of the Woburn, Mass., company sank almost 50% on March 23, after
short sellers took advantage of news from CIBC World Markets Corp. analyst
John Calcagnini, who received word back from the government after submitting
a request for information under the Freedom of Information Act. Calcagnini
said the government confirmed that the Federal Bureau of Investigation
conducted an investigation of the company, as reported by Barron's magazine
in November.
Shares of PolyMedica recently were up 38 cents, or 1.5%, to $24.63 on
volume of 784,700 shares. Average daily volume is 785,446.
