There is so much legislative history that favors my view that a Supreme Court decision would not be touchy at all. The fact is that the opponents of the freedom to keep and bear arms know this and such a case will not be brought on your theory. They would rather pursue and promote the myth of the militia constraint than try and have the issue opined upon by the Court.
