True but in 1998 when the market had it's big decline the VIX spiked to 61 and spent a
significant amount of time over 40.

It also spiked over 50 in 1997 and in 1989.

In 1987, when the market dropped, the VIX spiked to nearly 180.

Just because 40 seems high, it is based on normal trading and during abnormal declines,
the VIX is not bound by a set level.
