If in fact UTEK employees can elect to have their 401(k) plans administered by the B.J. Group, of which Brinker is a principle, then how is their choice to select the B.J. Group impacted by the fact that Bob Brinker recommended purchase of UTEK shares to his Marketimer subscribers, radio listeners and T.V. audience (as he did on the Nightly Business Report). It seems to me that the answer to this question could illuminate the discussion of whether there was any conflict of interest.

Even if there is absolutely no conflict, I personally would have wanted the relationship disclosed in the Marketimer at the time the recommendation was made. I don't believe the relationship was or ever has been disclosed in the Marketimer newsletter, but if I am wrong, please correct me.
