Keeping ships from unfriendly nations that come into your hands during undeclared war is a long naval tradition. (Not that I mean to say that it's right, or that fighting with countries you're at peace with is a good idea. Just that there are traditionally a lot of gradations between peace and war.) I'm guessing we get the Pueblo back about the same time that we give the Insurgente back to the French.
