As they say in sports, "It's crunch time." With only one day remaining before jury
selection is to begin at 9:30 AM EST, the two combatants, Rambus and IFX remain
locked in a torrid legal battle about to be played out in the Richmond, Virginia Federal
District Court. With over 240 docket entries over a span of more than six months;
neither side appears ready to begin bargaining for a settlement; at least on the surface.
One attorney told the author that on just volume of motions and filings, this case is
extraordinary. "Very few cases are as extensively litigated as the Rambus case seems to
be," said one attorney I talked to today who asked not to be identified.
Although jury selection begins Friday with sixty potential jurors being called to the
witness stand, actual selection of nine jurors is expected to take all day Friday, and
perhaps Monday morning as well. Typically, jurors are asked questions by attorneys in
order to insure that jurors are going to be fair, impartial, and carry no bias toward either
parties. The depth and spirit of this case may be reflected in the unusual opposition that
the competing attorneys have toward the suggested questions to be asked prospective
jurors. From the motion filings, it looks as if the judge will have to draw up the list of
questions for the potential jurors himself. One thing reamins for certain; this case is full of
surprises. There remains for the judge to decide a number of pre-trial rulings that could
steer the direction of the entire trial and there is a hearing scheduled for tomorrow
morning. As they say every four years at venues around the world, "Let the games
begin!"
