I think that part of the antitrust settlement with Intel gives AMD access to any extensions that Intel makes to the x86 instruction set. It would be a bit iffy, but AMD would probably embrace Intel's x86-64 instruction set if necessary. Intel would of course sue, claiming that their new instruction set is not an extension to IA32. What it will come down to is whether the courts accept Intel's claim that AMD is limited to IA32 extensions and that their new extensions are IA64 whatever, or whether the courts buy AMD's claim that Intel is extending the x86 instruction set.

Not until 1/02 at least. They won't make any "drop Itanium" decision until it is available on 0.13µ

Great! They will be ready about 4/03 and Microsoft will rebel after just having spent a billion to suppor the Itanium.
