been gone for the past week. Trying to catch up. I agree with Blake that comments of counsel in the heat of trial, especially in conference with the judge, need to be taken with a grain of salt. Both sides will be papering the file for appeal purposes, so the hand-wringing, chest-pounding stuff is not unusual....however, judges don't like too much of that stuff. A little goes a long way and needs to be used at the right moments.

I'm both sorry and glad I missed the trial activity up to now. Almost easier to read the synopsis after the fact and try to sense the proceedings.

I think there is a good chance at an infringement victory here unless the judge gets very proactive with his Markman misunderstanding. <G>

Infringeon had the means, the motive and by golly the opportunity to rip Rambus off and these trial reports make that obvious.

I hope for all the longs that I am wrong. It's a matter of percentages and with the judges stands on the Marman ruling I have a higher percentage down than up at this point.
