Don,

Of all people, you know the risk that we are taking. If you still like the Rambus business model, use the drop in price (if there is one) to help lower your cost basis. Until the next week or more use all the news to your advantage.

PS: I am not happy about this, but my cost basis ia lower now than it was by the end of last year. If things work out we should make some profit.

OK, I have now had a bite to eat after a really long day. there were some dicey moments this morning in court surrounding an admission that was shown to the jury yesterday. Without going into a lot of detail now, the judge could have ruled it a judicial admission which would have been real bad, but instead considered it a factual admission, wihich isn't quite as bad for the palintiff. Huber did testify but the lawyer allcock did not get the right words or the right facts out of him. So bad was it that this evening, Judge Payne even remarked that he couldn't believe the aproach he was taking to porve literal infringment. Allow me an editorial remark: I posted yesterday that it looked like to me the dog and pony show of this week was to make Rambus look good enough to survive the RICO and Fraud of this week's defense. I will stand by that characterization now. There was little given to the jury that will tie the three remaining patent claims to actual infringement. Huber's testimony didn't come close to doing it. Back to non-editorializing-the IFX Richmond Plant head spoke and the testimony seemed centered around the concept that IFX is pleading that they are really to poor to pay the royalty! I almost cried at that one! I took a lot of heat last Friday for posting the Jim Rockwell statement of his characterization "throwing in the towel". Well folks, that is exactly what Rambus attorney's have done with the 804 and the 214 patent. Given that 703 was out already; we are left with only three claims that the judge thinks that Huber might have touched upon. Allcock did not get Huber to give a strong statement about actual infringement. That's about it, folks, I'll try to answer questions off and on throughout the evening, but its been a long day.

Did we get taken to the cleaners or what! This is the worst possible scenario that is happening. The plaintiff, RMBS who brought the suit is going to have all their claims thrown out possibly, and the history of the judge in this case is telling us that is very likely. With the markman rulings he basically told rmbs to get the heck out of my courtroom. So now RMBS is in a situation were they are now on the defensive and IFX can win, and get treble damages for who knows how many millions of dollars. Ofcourse this will be appealed, and RMBS may never pay if they are found guilty, but its just another cloud over the stock, and personally I can't wait for RDRAM to ramp so we can kick the hell out of SDRAM and DDR.

I agree, but the damage is already done. Our legal team should be sued for malpractice, you don't go to trial unless you know you can win! IFX knew they could win once those markman rulings came out, RMBS should not have chanced it, now they might lose on counter claims from IFX, which could be millions of dollars! And more importantly this case sets precedent for MU and Hynix trials, those juries can no site case law from this trial going against RMBS. What a screw up! I wish we could replace monohan and allock, they just wanted their fees, when they should have been advising tate to forget this trial, and refile months later. You can be sure Samsung, and toshiba, and the 6 others are not going to pay DDR and SDRAM royalties now.

Apparently, RMBS management are only thinking about their butt so they directed the lawyer to concentrate on getting them offthe hook. Question is : will other DRAM compnies sue RMBS to get their money back since we have no
[fudging] SRAM or DDR patents to license to them. Can we get management to pay through their nose.

This is bullshit, Tate was deceived into thinking that this case is a no-brainer because Toshiba came to him and because these lawyers blew sweet smoke. Time for a reality check.

How long before one of its licensees stops paying royalties on SDRAM and DDR? It won't be long, I know I would stop paying if someone else beat it. This can turn into a real mess with a loss. If everyone did this, Rambus couldn't afford to fight. What a f**kin nightmare scenario. F**k you Judge Payne.

Too little time on the issue

This case was about infringement or what did they specificaaly do that infringed on Rambus IP. Too much time was spent on characterization of Infineon. ... The law firm should have known better and did an unbelievably bad job. I also feel that Rambus management should have seen this and should have tried to bias the direction of the case. maybe they did but bottom line, the law firm did a very bad job!

If Rambus loses this case, class actions will pour in. Rambus management represented to investors that Rambus had enforceable patents on DDR and SDRAM. If this is not true, investors will want a piece of flesh.
