CCAA question. If indeed the ASK price the day prior to closing (June 5th?) is used, and if the ASK price is in excess of .125, then how will the other provision of a majority stock ownership by Mancini/IMOIL be achieved?

$5 MILLION / .125 = 40 MILLION shares. With Mr Cala giving up 10 MILLION shares of his own, that leaves an additional 30 MILLION shares. Hence, 40 MILLION out of 80 MILLION O/S and a majority stock ownership (numbers just approximate). What if CCAA's ASK price went to .15 or .20 ?? The number of shares ISSUED given the filing would be LESS than 40 MILLION shares and IMOIL / Mancini would not have a majority. Am I missing something? How would this ambiguity if I am seeing this correctly be addressed? Any opinions? Still like CCAA just wondering about this paradox.
