I still haven't seen any evidence that shorting would be unavailable to pattern daytraders who fall below 25k of account equity. I'm inclined to think that you folks are jumping to conclusions.

If you are required to use margin to short, and a <$25k account can't use margin then they can't short. Isn't it that simple?
