Wasn't Tokoyo Joe deemed an investment advisor by the SEC? Suppose you were paying for the stock picking service. The stock pimping service is part of some scheme with a brokerage outfit. I wouldn't think that you would have to have an account with the broker to suffer damage. You just had to have been in the class that was being manipulated. I guess one question would be if you were aware when making the trades that the stock pumping service was receiving kickbacks or part of the profit of the broker.
