A trademark does not necessarily need to be registered to be used I don't think but that leaves it open for somebody else to register it ... I think.

For example you can legally use the TM after a phrase or word without having it registered. A worldwide registration could get relatively expensive ... maybe up to $5,000 but I'm just guessing.
