Hi Scared but Hopeful; I don't recall posting that I thought that the jurors would find for infineon in the Rico ., and I don't think I would do so. I may have posted that there is a possibility of that, but I am not about to predict what a jury is going to do.

I did post that I thought the judge would throw out the remaining three claims last week (see #reply-15754091
), but that was only after I had read the Infineon and Rambus briefs on summary judgement, and then reread the Judge's Markman memorandum. That was more than enough to predict the judge's actions, the prediction was as easy as they get. But I'm sure you can see that since the jurors haven't written anything that I've read, I can't predict what they're thinking on this.

Similarly, predicting that Rambus would lose the crime-fraud exception appeal was obvious (the bet with The Prophet ended with this post: #reply-15629290 ), after you read the briefs filed by the two sides and read the applicative transcripts.

You have to appreciate my position. Whenever I predict something and it doesn't come to pass I get to hear about it for years. So I only make the predictions that are painfully obvious.

As to it dragging out further, you can put money on it.

I tend agree with you.

Interestingly, if the judge thought the jury was going to find on the Rico and fraud charges then he would not have warned Micron to stay out of the case( because they would be bound by the result) IMO.
