As I understand it, there was a legal bar to a charge of treason during the Vietnam War. The problem was that it was not a declared war. Here's the relevant text from the Constitution:

Section. 3.
Clause 1:
Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

In a declared war, Fonda, and possibly Clinton, could have been charged and prosecuted for "adhering to their Enemies, giving them Aid and Comfort."
There being no declared war, North Vietrnam and the Viet Cong were not legally our enemies.
