POWELL: Yeah, well, it was following my calling them. But yes, that's right, at that point. WIDMANN: You called them to confirm they were going to represent you, am I correct? POWELL: Yes, because I did not want to be here today being deposed without counsel, and I didn't know if I needed my own counsel. And so they upheld the agreement that they would represent me. So I guess I would set the clock ticking at that day, whenever that day was. WIDMANN: Now, I don't want to know the amount, are you paying for attorney's fees? POWELL: No. WIDMANN: Do you know who is paying for your attorney's fees, if anyone? POWELL: No, I don't. WIDMANN: Did you have an agreement with Varian that Varian would pay your attorney's fees? POWELL: With Varian, no, I had no agreement with Varian. WIDMANN: How about with Ms. Felch or Mr. Zdasiuk, who are also parties? POWELL: No. The only thing I recall is that, as I say, when I made the statement initially and talked to Lynne Hermle about whether they would in fact represent me if it were needed going forth in -- I think she may have checked with someone at Varian at the level of Dick Aurelio or Dick Levy, and they agreed that yes, they would allow that to happen.
