ever hire an expert witness? <g> while I was in regulation I heard the term "non-discriminatory" argued about a whole bunch. Of course, the general definition of "non-discriminatory" simply means the same charge for the same service no matter who's buying -- your competitor or your own subsidiary ... the rub usually comes in the different kinds of services that are offered. This is why we NEED lawyers <g> sometimes folks like to play games with the definitions of services in order to provide services and charges that are as "preferential or discriminatory" as the law will allow to be called "non-discriminatory" -- so we look to court precendent, right?
